Banned for being in same map as hacker?

My friend says u can get banned for being simply in the same map as a hacker. God, is it true? First hand experience, anyone?

ive seen flying hackers in ch 1 Henesy/market/fm and yet ive never been banned

I don't think you would be banned if you're not doing anything related to the hacker. i.e. Party quest, looting, kill-stealing, etc.
