I was reading through the ToU of Nexon, and i came across this: "6.4 Software. Use or downloading of the Software is conditioned on your acceptance of the terms and conditions of our End User License Agreement and any license agreements relating to such Software, including all third party agreements. By using the Software, you agree to all of the terms and conditions set forth in such agreements." It says that if you download the software, you automaticaly agreed to accept the terms of the agreement. THE LOOPHOLE? You never agreed that if you download the software that you'd agree to accept the terms . Therefore, downloading and not agreeing cannot be held against you. Just thought i'd share that with everyone. EDIT: Im talking, if you never agreed to the ToS, prior to downloading. As in, privately downloading with no obligation, they cannot hold anything against you. But.. Whats the point of downloading it and not using it..

Actually it can be held against you. Nexon can penalize any user for any reason at any time they like, which is also somewhere in the ToS.

True. Unless you didn't make an account, you can't say you don't agree. You'd have to check that little "i agree" box

True. It also says somewhere in there that nexon can fine you a minimum of like 100 dollars for using 3rd party programs. Now we all now that is just unrealistic. Imagine all the money they'd make of DxWnd users xD

You never agreed that you'd have to pay if you play the PS |

To get the game, you must download it. To play the game, you must accept their rules. Simple. It says by download OR use. I mean, you can make a crap account and not play, but then that's not really any helpful is it? YOU DO AGREE, that's the point they make by saying, by using this program, you accept these terms. You would fail as a lawyer.

Using the software and not agreeing to the ToS implies playing someone else's account. In the ToS it states that an account can only be played by the creator.
